Terms of service

1. What the site is

The site is software for running a private football pool among people who know each other: it records picks, locks them at kickoff, grades them against the results and keeps the standings. It is provided for entertainment purposes only.

2. What the site is not

• The site never collects, holds, transfers or pays money, and it awards no prizes. No money passes through the site or its operator.
• The site is not a gambling service, a sportsbook or a payment service, and it may not be used to run one.
• The site does not offer, arrange or process wagers. Any arrangement among the members of a pool about entry fees or prizes is theirs alone, made outside the site.

3. Who is responsible for a pool

Each pool is created and run by its commissioner. The commissioner, not the site, is solely responsible for the pool: for who is in it, for its rules, and for making sure the pool is lawful in every place where any of its members live. Some states restrict or prohibit pools with an entry fee and a prize; it is the commissioner's duty to know and follow the law that applies, and the site is void where prohibited.

4. Dues tracking

A pool starts with no entry fee and no prizes. A commissioner may turn on dues tracking, an optional feature that lets the site record which members the commissioner has marked as paid and calculate how a prize amount would be shared, on these conditions:

• The site still never collects, holds or pays anything. Members settle with one another directly, and the site only records what the commissioner enters.
• Every dollar contributed by members is returned to members as prizes. The commissioner may not keep any share of it, and nobody but the members may benefit from it.
• The entry fee may not exceed $150 per member per season.
• Every member of a pool with dues tracking on must be at least 18 years old, or 21 where the law where they live requires it.
• Dues tracking is not available to a pool run from WA, MT, NV, IL, and the operator may withdraw it in other places at any time.
• The commissioner confirms all of the above when turning the feature on, and confirms that the pool is lawful where each of its members lives.

5. Age

You must be at least 18 years old to create a login. By creating one you confirm that you are.

6. Your login

Keep your password to yourself. You are responsible for what is done with your login. A commissioner may remove a member from their pool at any time; the operator may disable a pool or a login that breaks these terms.

7. Fees for the site

Use of the site may be offered free or for a flat subscription paid by the commissioner. Any such fee is for the software and hosting alone. It is never a share of, and never varies with, any money the members of a pool put up among themselves, and it may not be paid out of such money.

8. Game data

Schedules, results and betting lines are drawn from third-party sources and can be late, missing or wrong. The commissioner can correct a result by hand. The site is not liable for the consequences of a wrong or late result.

9. No warranty; limit of liability

The site is provided as is, without warranty of any kind. To the fullest extent the law allows, the operator is not liable for any loss arising from your use of the site or from any pool run on it, including any dispute among the members of a pool. The operator's total liability to you for any claim is limited to the amount you paid the operator for the site in the twelve months before the claim, if anything.

10. Changes

The operator may change these terms. The date at the top says when they last changed; using the site after a change means you accept it.
